  The Right to Information Act, 2005
 
   

As a public authority, the Raj Bhavan establishment has certain obligations to discharge under the RTI Act, 2005 which are as follows :-

Under section 4 (1) (a) we have to maintain all our records duly catalogued and indexed in a manner and form which facilitates dissemination of information under the Act.  Those records that could be computerized should be identified and within a reasonable time, subject to availability of resources, computerized and connected through a network all over the country, so as to facilitate access of such records by the public.

Section 4(1) (b) provides that every public authority should publish a manual incorporating several information such as particulars of the organization, functions and duties; powers and duties of its officers and employees, decision-making process, channels of supervision and accountability; directory of its officers and employees and their monthly remuneration, etc.

Section 5 (1) stipulates that every public authority shall designate a State Public Information Officer who shall be responsible to provide information to members of the public requesting for information under the Act.

Section 6 provides that any member of the public who desires to obtain any information under this Act, shall apply to the State Public Information Officer with accompanying fees, as may be prescribed.

Section 7 provides that it shall be the duty of the State Public Information Officer to provide the information requested for, within 30 days, of the receipt of the request.

There are provisions under this Act to extend the time limit of 30 days if the fees are not adequately paid or information has to be procured from some other sources.

Section 8 and 9 provide for the exemptions from disclosure of information.  These exemptions include information which would effect the sovereignty and integrity of the country; forbidden to be published by any court of law; breach of privilege of Parliament or legislature, etc.
